His conduct described constitutes potential judicial misconduct in violation of the Texas Code of Judicial Conduct, including an abuse of discretion, denial of due process, and a failure to maintain judicial impartiality. The pattern of rulings and behavior reflects apparent bias and prejudice, undermining the requirement of a neutral and detached tribunal. Additionally, there are serious concerns regarding improper ex parte communications and actions taken outside the scope of lawful judicial authority (ultra vires). Such conduct erodes the integrity of the proceedings and raises substantial constitutional concerns. While the judge is presumed to have taken a valid oath of office and to be properly qualified, the behavior observed raises questions about fitness to preside and adherence to the ethical and legal obligations required of the judiciary. Legal Knowledge: Monk’s behavior raises concerns about fitness to preside and lacks basic knowledge on Article I, Section 19 of the Texas Constitution. And he is short. Fairness & Impartiality: The proceedings appear to operate under a flexible interpretation of impartiality, one that consistently produces the same direction of outcomes regardless of opposing arguments. Communication: communication changes without notice depending on the party or issue beng presented Timeliness: none
