I am a survivor of DV where I was choked and raped by my ex resulting in pregnancy. After being absent almost completely for 2 years, my ex returned when a PO was filed against him. He retaliated by fighting for custody even with ongoing concerns of child abuse including child SA. Within 6 months the judge gave him custody even being $20,000 in arrears, admitting his mom would be watching the child, and with her only knowing her for a few months and being 2 years old. I was denied protective orders during confrontations and then was put on supervised visitation for taking my daughter to the doctor to document ongoing vaginal issues and other abuse concerns. When my ex withheld her, I filed a Habeas Corpus and was denied even with the judge admitting the divorce decree was the last standing order. It’s been over a year since I seen my toddler and this judge refuses to abide by the law. Legal Knowledge: Several due process rights denied, parental rights denied, refused protective orders despite ongoing abuse concerns, etc. all which points to major concerns of bias. Fairness & Impartiality: Even with evidence, the judge refused to protect me and my daughter. TROs my ex issued against me for things like “taking her to the doctor” were granted within an hour while my concerns of SA with SANE exams, police reports, medical evidence were dismissed and I was forced to continue to allow him to see her or risk custody loss which the judge did a month and a half later. Judicial Temperament: He seems very flippant with the way he treats situations and refuses to consider abuse or the parent child relationship. Communication: Many of the rulings lacked clarity. I had to ask questions and a lot was left to ambiguity. Rulings later seemed to change. Timeliness: My case has been delayed numerous times often giving my ex several continuances. On the other hand, if I asked for a continuance for medical reasons or asked for expedited response, I was denied or the case was delayed.
