filed an emergency writ of mandamus to stop a rogue judge from proceeding with a TPR and force the judge to answer the recusal motion and stay the proceeding until written findings were recorded before continuing with the merits of the TPR Communication: claimed that because it wasn’t involving adoption then it’s out of their jurisdiction. if correct then I understand their position and why it was sent back. just seems strange to me that this is the correct process Legal Knowledge: emergency writ of mandamus to force the juvenile court judge to rule on pending threshold motions, stop an in progress TPR hearing where the father was excluded for not having standing due to not legitimatizing his daughter but failed to acknowledge that a Florida born child and the fathers name being on the birth certificate is the equivalent to Georgia legitimizing, and make him the legal father. the court held onto this emergency write for 5 days, let the TPR conclude, then instead of ruling on my behalf, she instead deferred, and sent it down to the juvenile court! so this judge wants to put a mandamus in front of the judge who it’s against?! make that make sense Fairness & Impartiality: sent the mandamus back to the same judge in the juvenile court for which the writ is against. Judicial Temperament: deferred to lower court . it’s bettter than dismissal Timeliness: took a week to get a response to an energy motion that was just sent back to the juvenile court. this could have been done the same day.
